EFT Service Agreement
The following terms govern the use of electronic funds transfer ("EFT") services of the financial institution indicated at the end of this Agreement ("we" or "us").
- Services
- Card Services. You may perform the following services
with the EFT card issued by us ("Card"). Your Card can be used at automated
teller machines and terminals used by participating merchants to process
point of sale transactions identified as Magic Line machines or at machines
in the other networks in which we participate. You may perform some or all
of the following transactions with your Card:
- Withdraw cash from your checking/ sharedraft and/ or savings/share accounts ("Accounts").
- Make deposits to your Accounts. Deposits made at an ATM are subject to proof and verification which may delay crediting your Account. If you deposit an item drawn on a financial institution other than us, you authorize the financial institution owning the terminal to act as a collecting bank and it will be deemed to be the depository institution. If such an item is not paid by the financial institution owning the terminal to act as a collecting bank and it will be deemed to be the depository institution. If such an item is not paid by the financial institution upon which the item is drawn, we well not be liable for any failure to return or send notice of dishonor to you by the midnight deadline.
- Transfer funds between your Accounts.
- Check the balance of your Accounts.
- Pay for purchases at places that have agreed to accept the Card, including purchasing goods and services from Visa or MasterCard merchants. The funds to pay for such purchases, including receiving cash back will be debited from your primary personal checking/ sharedraft account. These transactions may be transmitted immediately. We may place a hold on the funds in your Account as soon as we receive notice that you have performed this kind of transaction.
- Pay bills directly from your Accounts in the amounts and on the days you request.
Some of these services may not be available at all terminals. If you become indebted to us due to an EFT transaction, we may use the funds in your Accounts without notice to you to pay off the debt. If an Account is a joint account, the funds in the joint account may be used to pay off the debt without notice to you or any joint owner. You will release us from all liability arising out of the right to pay debts from your Accounts. Further, you authorize us to draw on any line of credit you have attached to any Account to pay any debt you owe us.
- ACH Services. We may make the following automated clearing
house services available to you:
- Preauthorized Transfers. You may authorize us or others to make transfers to or from Accounts on your behalf before the transfers are made, otherwise known as "preauthorized transfers". These transfers are performed electronically, and governed by federal laws pertaining to EFT services, which entitle you to certain protections contained in this Agreement, unless the transfers are initiated using an access device not issued by us.
- Other Access Devices and Remote Services. You may make transfers from your Accounts using access devices other than the access device issued by us. Further, you may make transfers by telephone or computer if you have arranged with the third party for these services. Such transactions are NOT covered by this Agreement, except that we will provide you information on your periodic statement describing them, and disputes involving point of sale transactions will be handled by us under this Agreement. All inquiries and error notices should be directed to the issuer of the access device.
- Electronic Check Conversion/Electronic Returned Check Fees If you pay for purchases or bills with a check or share draft you may authorize your check or share draft to be converted to an electronic funds transfer. You may also authorize merchants or other payees to electronically debit your account for returned check fees. You are considered to have authorized these electronic funds transfers if you complete the transaction after being told (orally or by a notice posted or sent to you) that the transfer may be processes electronically or if you sign a written authorization.
- Card Services. You may perform the following services
with the EFT card issued by us ("Card"). Your Card can be used at automated
teller machines and terminals used by participating merchants to process
point of sale transactions identified as Magic Line machines or at machines
in the other networks in which we participate. You may perform some or all
of the following transactions with your Card:
- Limits
We may establish card limits, such as the daily ATM withdrawal limit, the daily POS purchasing limit, a total daily limit and the POS spending limit ( for transactions using your ATM card with a Visa or MasterCard logo on it). The limit for cash received from a merchant through a point of sale transaction will be counted against your daily limit. Please contact us directly to receive detailed information on the limits pertaining your card, or to request on change, such as lowering a limit, to the card activity limits.
- Your Rights and Responsibilities.
- Right to Receive Documentation. You will receive a receipt when you use you Card at a terminal or participating merchant. You will receive a periodic statement unless there are no EFT transfers in a particular month. In any case, you will receive a statement at least quarterly, unless your Account is dormant. If you have arranged to have direct deposits made to your Account at least once every 60 days from the same person or company, you can call us at the number indicated at the end of this Agreement to find out whether or not deposit has been made. If you bring your pass book to a branch, we will record any preauthorized deposits that were made to your account since the last time you brought in your passbook.
- Notification of loss or Theft. IF YOU BELIEVE YOUR CARD HAS BEEN LOST OR STOLEN, OR THAT SOMEONE HAS TRANSFERRED OR MAY TRANSFER MONEY FROM YOUR ACCOUNT WITHOUT YOUR PERMISSION, YOU SHOULD CALL OR WRITE US AT ONCE AT THE TELEPHONE NUMBER AND ADDRESS LISTED ON YOUR MONTHLY ACCOUNT STATEMENT OR ON THE MAILER ON WHICH YOUR CARD WAS RECEIVED. You must tell us AT ONCE if you believe your Card has been stolen or lost, Telephoning is the best way of keeping your possible losses down. If you do NOT tell us within 2 business days after you learn of the loss or theft of your Card, and we can prove we could have stopped someone from using your Card without your permission if you had given us notice, you could lose as much as $500. Also, if your statement shows transfers that you did not make, tell us at once. If you do not tell us within 60 days after the statement was mailed to you, you may not receive back any money you lost after 60 days. Therefore, you could lose all the money in your Account if we can prove that we could have stopped someone from taking the money if you had given us notice in time. If a good reason like long trip or hospital stay, keeps you from giving us notice, we will extend the time periods. We may require you to provide us with verification of extenuating circumstances before extending these time periods.
- Using Your Card and PIN. Your Card remains our property and may be revoked at any time without notice. You will not use your Card for a transaction that will cause your Account balance to go below zero. We are not required to complete that transaction, but if we do, you will pay us the amount of the transaction and any fees. You will notify us if the Card is lost or if the secrecy of the personal identification number ("PIN") is compromised. You will not reveal the PIN to any person not authorized to use the Card. You will not write the PIN on your Card or any item kept with the Card. You may change your PIN if you feel that its secrecy has been compromised.
- Right to Stop Payment of Pre-authorized Transfers. If you have asked us to make preauthorized transfers out of your Account, you may stop any of the payments. To do so, call write us at the numbers indicated at the end of this Agreement in time for us to receive the request 3 business days or more before the payment is scheduled to be made. If you call, tell us the following: your Account number, the date of transfer, to whom the transfer is being made, and the amount. If you call, we may require you to write us within 14 days. If the payments vary in amount, the party that you will pay will tell you (unless you have agreed otherwise) 10 days before each payment, when it will be made and how much it will be. If you order us to stop one of these payments in accordance with this section, and we do not stop the payment, we will be liable for your losses or damages.
- Disputes
- Point of Sale. We will reverse an EFT transfer from a point of sale transaction and recredit your Account if all of the following occur: 1) you provide us notice of having made a good faith attempt to seek redress and made an assurance to us of the return of the goods in dispute, where returnable goods are involved, 2) the amount of the transaction is $50 or more, and 3) within 4 calendar days of the transaction, we receive during normal business hours a written or oral request for the reversal. If the notice is given verbally, you must follow the reversal order, providing notice and assurance in writing within 14 calendar days on a form provided by us. If you don’t notify us in writing, we will reinstate the original debits and credits.
- Errors or Questions about Transactions. Call us at
the telephone number or write us at the address on your Account statement
as soon as you can of you believe the statement or a receipt is wrong, or
if you need more information about a transaction to assert an error. We
must hear from you no later than 60 days after we sent you the FIRST periodic
statement on which the error appeared. You must do all of the following:
1) give us your name and Account number (if any), 2) describe the error
or transaction you are not sure about and explain why you believe it is
an error or why you need more information, 3) give us the dollar amount
of the suspected error. If you give us oral notice, you must send in your
complaint or question in writing within 10 business days.
Except for point of sale and foreign country EFT transactions, we will investigate the matter and tell you the results within 10 business days after we hear from you and will correct any error promptly. If the notice of error involves an electronic fund transfer to or from the Account within 30 days, after the first deposit to the Account was made ("New Account EFT"), we will investigate the matter and tell you the results within 20 business days after we hear from you. If we need more time we may take up to 45 days,( or 90 days for a New Account EFT) to investigate the complaint, we will credit your Account within 10 business days for the disputed amount, or within 20 business days for a New Account EFT.
If the alleged error involves and EFT from a point of sale transaction, or the transaction was made other than in the United States or Puerto Rico, we will determine whether the error occurred within 10 business days after we hear from you and will correct any error promptly. If we need more time, however, we may take up to 90 days to investigate your complaint or question. If we decide to do this, we will credit your Account within 10 business days for the amount you think is in error, so that you will have the use of the money during the time it takes us to complete our investigation.
If we ask you to put your complaint or question in writing and we do not receive it within 10 business days, we may not credit your Account. We will tell you the results within 3 business days after completing our investigation. If we decide that there was no error, we will send you a written explanation. You may ask for copies of the documents that we used in our investigation.
- Our Liability For Failure to Complete EFT Transfers. If
we do not complete an EFT transfer on time or in the correct amount in accordance
with this Agreement, we will be liable for your losses or damages. However,
we will not be liable, for instance:
- If, through no fault of ours, you don’t have enough money in your Account to make the transfer or if your funds are subject to legal encumbrance.
- If we have terminated this Agreement.
- If any part of the system supporting the terminal was not working properly and you knew that before you began the transaction or during the processing of the transaction.
- If the terminal where you attempt the transaction did not have enough money to complete the transaction or support the type of transaction you requested.
- When your Card has been reported lost or stolen or we have the reason to believe that a transaction has not been properly authorized.
- When despite reasonable precautions taken by us, an act of God or other circumstances beyond our control interferes with or prevents the transaction.
- When we receive inaccurate or incomplete information needed to complete a transaction.
- If any authorizations for completing the transfer have been revoked by operation of law.
- Card Association Limits on Your Liability.
- Visa Checks Cards and Interlink Transactions. For unauthorized transactions on a lost or stolen Visa Check Card, you will have the following liability: a) $0 liability if you report the loss or theft of the Card within 48 hours of the time you discovered the Card was lost or stolen, and b) $50 liability if you report the loss or theft of the Card after 48 hours of the time you discovered the Card was stolen. If we determine that you were negligent or fraudulent in handling your Account or your Card, these limits may not apply. Effective April 1, 1998, if you notify us of an unauthorized Visa transaction, we will provide you with provisional credit within 5 days of the notice.
- MasterCard Debit Cards. For unauthorized use of a MasterCard debit card, you will have the following liability: a) $0 liability if you report the loss or theft of your Card to us within 24 hours of discovery of the loss or theft, if you have exercised reasonable care in safeguarding the card from the risk of loss or theft, if you have not reported 2 or more incidents of unauthorized use in the immediately preceding 12 month period, and if the account linked to the card is in good standing, or b) if the conditions set forth in Section IV.D.2.a. above have not been met, the lesser of $50 or the amount of money, property, labor or services obtained by the unauthorized use before notification to us. "Unauthorized use" means the use of a MasterCard card by a person other than you, who does not have actual, implies, or apparent authority for such use, and from which you receive no benefit.
- Charges
We may impose certain charges or minimum balance requirements when you use your card and with the Accounts accessible by your Card. All fees and minimum balance requirements are detailed in the schedules given to you when you opened your Account.
- Notice of Basic Safety Precautions.
When using your Card at an ATM, you should:
- Be aware of your surroundings, particularly during the hours of darkness,
- Be accompanied by another person when using an ATM during the hours of darkness,
- Refrain from displaying cash, place cash in a pocket as soon as transaction is completed, and count cash in the safety of a locked enclosure such as your car or home,
- Use another ATM or return at a later time of anything suspicious is noticed when using or considering using an ATM, and
- Report all crimes immediately to the operator of the ATM or to local law enforcement officials.
- Additional Provisions.
We will disclose information to third parties about your Account or transfers where it’s necessary to complete a transfer or investigate errors, or to verify the existence and condition of your Account for a third party, or to comply with governmental or court order, or with your consent. Merchant authorization messages are permissible disclosures, and you will release us and hold us harmless from any liability arising out of those authorizations. Business days are Monday through Friday, excluding holidays. We may change any of the terms of this Agreement and the schedule of fees at any time upon 30 days prior written notice to you. If you do not agree with the change, you must notify us of that prior to the effective date of the change and cancel this Agreement. If you don’t so notify us, you will be deemed to accept the change. We may cancel this Agreement at any time, without giving you prior notice. If you or we cancel this Agreement, you will surrender your Card and you may no longer use any of our EFT Services other than the automated clearing house services.
- Notification of Regulatory Authority.
This Agreement and the EFT Services are governed by State and Federal law. You may notify the following of any violation of law:
